However, I know that many people who have been diagnosed with noise-induced hearing loss are hesitant to apply for industrial accident compensation or are not taking action because they do not know how to apply for industrial accident compensation or the process involved. Therefore, today, we will take the time to learn about the process of applying for industrial accident compensation for noise-induced hearing loss. Before preparing for the application, there are two things you should know. In general cases of industrial accidents, it is common to apply for medical benefits when applying for industrial accident compensation initially. However, in the case of noise-induced hearing loss, you should apply directly for disability benefits.

I am applying for industrial accident compensation. In general, for regular medical care, the principle is to apply for treatment within 3 months if it is possible. When it becomes a chronic condition, then you apply for disability benefits. However, noise-induced hearing loss is untreatable and irreversible, so the process skips medical care and goes straight to applying for disability benefits. Another thing to keep in mind is when exactly you should apply for disability benefits for noise-induced hearing loss. The starting point of this 5-year period is crucial to know. In the past, it was considered from the date of diagnosis by the company's medical institution, and within 5 years from that date, you had to apply. However, recently, it has been confirmed by the court that the date of recognition of disability is the standard, based on the issuance date of the diagnosis and opinion statement at that time.

Therefore, the Korea Workers' Compensation and Welfare Service recently adjusted the guidelines based on recent cases. In other words, for the payment of disability compensation, you should consider the date of diagnosis and the earliest date of issuance of an audiogram or medical opinion as the criteria. However, if there is a disability diagnosis, including a disability assessment under the Disabled Welfare Act before claiming disability compensation, and if there is a disability diagnosis confirming a disability level of 40 or more for more than 10 days in the first examination, you can determine the date of issuance of the diagnosis or medical opinion as the diagnosis date. In cases where the date of issuance cannot be confirmed, you can determine the date of registration for disabled benefits as the diagnosis date. So, if you are within the period to submit evidence that you can apply for compensation for noise-induced hearing loss, you need to prepare again. Let's take a look at what is needed. Do you see the application form next to you? It's the application form for disability benefits.

When applying for disability benefits, you need to fill out your personal information, such as your own details and relevant information. You also need to provide consent for various uses of personal information. Explain the details about the applicant. The most important thing is as follows: please take a look. When verifying the document, besides the actual document, write down your name, social security number, and address. Check the hearing impairment status at the time of employment. Also, check the commuting time, relationship with the insured, and fill in the business name and employer's name. The most important thing is that below, you must write down the noise exposure at the workplace. However, when filling out this item, many people may not remember the address of the workplace they worked at decades ago, or may not recall the employer's name, employment period, etc. In most cases, people may not remember these details clearly. In that case, how can you confirm this? I will give you a tip. The National Tax Service or the Korea Workers' Compensation & Welfare Service can provide the information.

I can check by requesting issuance confirmation. The sound that can be verified by the National Tax Service is called an income certificate. Also, through the Employment Security Center or the Korea Workers' Compensation & Welfare Service, if you request employment insurance enrollment history, it can be confirmed. In this data, it specifies exactly which workplace you worked at from when to when. If such details are not available, you can request bank statements showing salary payments or provide testimonies from colleagues who worked together at that time to verify employment history. However, in cases where taxes were reported in the distant past through bank accounts but salaries were paid in cash, which was quite common, how can employment details be proven? If there are colleagues who worked together at that time, their testimonies can be used for verification. However, credibility is high only if they worked together during the same period.

It seems like it would be good to know the details. This is about a disability diagnosis report. The individual should obtain this report through the main doctor at the hospital where they have been receiving treatment. When receiving this diagnosis report, please do so at a designated medical institution for reinsurance. When obtaining the medical opinion, make sure to also get the test results and medical records ready. The next thing to prepare is to obtain the medical history, such as the professor's employment history and health insurance treatment records. This is to confirm whether there are existing illnesses. If there have been issues with the ears in the past and received treatment, it is for confirming whether treatment was received and for how long. However, if the individual had a medical history like otitis media, it would be helpful to submit medical records to confirm that it has been cured and does not affect hearing.

When your documents are ready like this, you can apply for industrial accident compensation to the Korea Workers' Compensation and Welfare Service. Industrial accident compensation application can be done by mail, in person, or by fax. Now that we have prepared all the necessary documents for the industrial accident compensation application as mentioned above, we have applied to the Korea Workers' Compensation and Welfare Service. Next, let's find out how the Korea Workers' Compensation and Welfare Service determines the recognition of industrial accidents. First, the Korea Workers' Compensation and Welfare Service investigates the work history. As I mentioned earlier, they will request documents related to work history. Then, the investigation process will be carried out regarding the degree of disability. If these are not submitted, the Korea Workers' Compensation and Welfare Service will request them. After investigating the work history, the next step is to examine the level of noise exposure. If you were working at a noisy workplace at the time of the accident, and if you were still employed at the time of the accident, the results of the workplace noise exposure measurement will be used as a principle for the determination.

I judge that if there were no exposure measurement results during the working period, but recent data exists and there have been no changes in the work content, that data could be utilized. However, if someone left their job at the time of application and states that they resigned from a workplace, the judgment will be based on the current operating status of that workplace. If the workplace is still operating, the judgment will be based on the work environment measurement results from the current situation. If the workplace has closed down, the judgment will be based on the work environment measurement results from a similar type of workplace. Subsequently, existing exposure investigations will be confirmed through health insurance claim history. Once all these procedures are completed, the Labor Welfare Corporation will conduct a special examination to confirm the disability status. Immediate examinations are carried out at the Labor Welfare Corporation as soon as concerns are raised. The special examination period is preferably set at 91 days, and the hearing test is conducted based on the judgment of the examination, lasting for 3 days.

Every 7 days, we are conducting inspections at least 3 times, but recently, due to issues with the workload, the inspection period is gradually getting longer. Knowing this point would be helpful. Now, once this special examination is completed, the disability level will be determined. The determination of the disability level is made through consultation with the Otorhinolaryngology specialist and if a specialized assessment is required, it will be determined through comprehensive assessment by the Medical Integration Committee. In this case, if there is no significant difference in the results of the three hearing tests conducted during the three special examinations, the lowest level will be determined as the standard for hearing impairment.

Once this is done, the disability grade will be determined, and disability benefits will be paid according to the disability grade. In the case of sensorineural hearing loss, the disability grade is divided into grades 4, 6, 7, 9, 10, 11, and 14, depending on the degree of hearing loss. The grade is determined based on the pure tone audiometry results. You can refer to the table below. Today, we looked at the application process and procedures for sensorineural hearing loss.
